Subject: -    Decision Upon The Appeal Of Mr. Amjad Saeed Yazdani Against The
Result Of Scrutiny Of Nomination Papers For Election 2010.

Dear Sirs,

    A meeting was held under the Chairmanship of President HOBA Syed Ashfaq Hussain to consider the subject appeal under Article 19.k of Articles of Association. Other candidates also showed their concern. The Appellate Authority constituted a wider Committee so that the result of scrutiny is also witnessed in the light of rules and regulation. The Committee comprised of the following: -

2.    Capt (R) Nayyar Islam (Secretary General HOBA)
3.    Lt.Col.(R) Ejaz Gillani
4.    Mr. Saleem Akram
5.    Mr. Asmat Saleem
6.    Dr. Saad Azeem
7.    Mr. Saleem Mughal
8.    Dr. Faisal Manzoor
9.    Seiral 1 to 8 attended where as Brig (R) Noor-ud-Din Ahmed and Engr. Sikardar Hayyat Khattak sent their apologies.

The participants unanimously gave their verdict that the result of the scrutiny of the nomination papers was under prescribed rules. The Committee agreed that the rule of law must be upheld. It was appreciated that for the first time an Election Schedule is issued to allow all the members to take part in the Elections. The committee suggested that the procedure for elections should be completed to set an appropriate example. It was also unanimously agreed that for the first and the last time the candidates be allowed to participate in election, ignoring their mistakes, so as to complete the election procedure as an example. Hence the Appellate Authority has allowed all the candidates mentioned above to contest election against the seats mentioned in their nomination papers.

According to the desire of respectable members the Memorandum & Articles of Association has been amended by following the procedure laid down in the Societies Registration Act and keeping in view the rights given in the Constitution of Pakistan. It has been kept in mind thatHOBA should grow as an institution and should have continuation of working in spite the change of office. Rights and duties of members and office bearers are clearly defined. The procedures are enacted to ensure smooth working with due honesty and impartiality.
